1.1 "The Company" refers to Up & Away, a sole trader business.
1.2 "The Hirer" refers to the individual, company, or organization hiring equipment from the Company.
1.3 "Equipment" refers to the bouncy castles, inflatables, accessories, and any other items provided by the Company.
2.1 The Hirer must be aged 18 or over to enter into this agreement.
2.2 Equipment is hired out subject to availability and receipt of a signed booking confirmation.
2.3 The Hirer is responsible for providing accurate delivery and collection information, including sufficient access for delivery vehicles.
2.4 Equipment is strictly for outdoor or indoor use as specified by the Company and must not be moved once installed.
3.1 A deposit is required at the time of booking. The booking is only confirmed upon receipt of the deposit.
3.2 Full payment must be made before or at the time of delivery unless otherwise agreed.
3.3 Deposits are non-refundable unless the Company cancels the booking.
3.4 If the Hirer cancels within 48 hours of the booking, the full hire fee may still be payable.
3.5 The Company reserves the right to cancel a booking due to adverse weather, unsafe conditions, or unforeseen circumstances. In such cases, a full refund or rescheduled booking will be offered.
4.1 Delivery and collection times will be agreed upon at the time of booking. The Hirer must ensure someone is present to sign for the Equipment.
4.2 Equipment must be available for collection in the same condition as delivered, allowing for reasonable wear and tear.
4.3 Late return or refusal to allow collection of Equipment may incur additional charges.
5.1 The Hirer is responsible for the safety and supervision of the Equipment and its users from the time of delivery until collection.
5.2 The Hirer must ensure that:

5.4 Users must vacate the Equipment during strong winds, heavy rain, or other adverse weather conditions.

7.1 The Hirer is responsible for any damage, loss, or theft of the Equipment during the hire period.
7.2 The Hirer agrees to cover the cost of repair or replacement for any damage beyond reasonable wear and tear.
7.3 The Company holds no liability for injury, loss, or damage arising from misuse, improper supervision, or failure to follow instructions.
7.4 The Hirer agrees to indemnify the Company against any claims, demands, or legal actions arising from the use of the Equipment.
8.1 The Company maintains public liability insurance for incidents caused by Equipment failure or Company negligence.
8.2 This insurance does not cover the Hirer’s negligence, lack of supervision, or misuse of the Equipment.
8.3 The Hirer is encouraged to obtain additional insurance if deemed necessary.
9.1 Equipment cannot be used in winds exceeding 24km/h (15mph) or heavy rain due to safety regulations.
9.2 The Company reserves the right to cancel or terminate hire if weather conditions are deemed unsafe.
9.3 No refunds will be issued for weather-related interruptions after Equipment delivery unless otherwise agreed.
10.1 The Hirer agrees to indemnify the Company against all liability, claims, damages, losses, or expenses resulting from the use of the Equipment.
10.2 The Company provides safety guidelines, but ultimate responsibility lies with the Hirer.
11.1 The Hirer must ensure compliance with all relevant local laws and regulations while using the Equipment.
11.2 Any breach of local laws or regulations is solely the Hirer’s responsibility.
12.1 The Company reserves the right to terminate the hire agreement immediately if terms and conditions are breached.
12.2 No refund will be provided in cases of breach of agreement.
13.1 This agreement shall be governed by the laws of the Republic of Ireland.
13.2 Any disputes arising under or in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the courts of the Republic of Ireland.
